Basehor council grants request for zoning change

The Basehor City Council voted 4-0 Monday night to overturn a recommendation by the city's planning and zoning commission and grant a zoning change for David Scott's 12.6 acres of land located at the north end of the old Meyer Dairy property.

Scott was requesting a zoning change for the land, which is bounded on the west by 147th Street and on the south by Parallel, from light industrial to planned industrial.

During previous meetings, the council and the zoning commission expressed concern about roads and easements, particularly because a purported adjoining landowner, Larry Stockman, Jr., addressed the easement concern.

The council heard a detailed presentation about easement rights and claims by Scott that Stockman is not legally an adjoining landowner.

Mayor John Pfannenstiel indicated the easement questions were still in doubt and said the board could not act until it was resolved. However, Scott's attorney, Elvin Shields, said further delay on the city's part would be unfair.

"There is a disagreement with the neighbors and if we have to litigate it we will," he said. "Mr. Scott has been trying to get utilities in his three buildings, which were zoned by the county in the spring before you annexed his land, but your cease and desist orders are not allowing the utilities to provide him service. This is devastating to his business. You knew it was industrial land when it was annexed."

Shields added there was no question roadwork would be necessary in the area, but it would be unfair to hold Scott's property "hostage."

"It is inappropriate to send this back to planning and zoning. You are telling David Scott his 12 1/2 acres has to pay for a new 147th and Parallel intersection," Shields said.

Following Shields' remarks, the council voted 4-0 (Councilman Joseph Odle was absent) to approve the change.

In other action the board:

voted 3-1 to adopt a two-year staff and equipment plan. Councilmen Victor Ziegler, Burl Gratny and Chris Garcia voted for the adoption, Councilman Robert Vervaecke voted against it.

voted 3-1 to purchase a new snow blade for a city truck for $3,032. Vervaecke voted no.

voted 4-0 to purchase software maintenance agreements for the city's computers.

was informed by Police Chief Vincent Weston that the city's request for a COPS grant for a new police officer next year had been turned down. He said other avenues were being explored to find grants for another police officer.

was informed that the city received a Bronze Star from the Kansas Municipal Insurance Trust and would receive a 1 percent discount in workman's compensation insurance because of the city's safety record.

heard a presentation from proponents of the county's ballot initiative to make judgeships elective offices.
